1. Agreement to Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“you”, “your”, “customer”, “user”) and Haisel LLC (“Haisel”, “we”, “us”, “our”) governing your access to and use of our website, www.haisel.studio (the “Site”), and any purchases of products or services made through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase from us.

2. Eligibility

You must be at least 18 years old to make a purchase or use the Site. By placing an order, you represent that you are legally capable of entering into a binding contract.

3. Products, Pricing, and Availability

3.1 Product Descriptions
We make every effort to display accurate product descriptions, materials, dimensions, weights, finishes, and images. However, natural variations in gemstones, metal tone, patina, and handmade finishing may occur. These variations do not constitute defects.

3.2 Pricing and Modification
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors at any time, including after an order is placed.

3.3 Made-to-Order Production
Most Haisel pieces are made to order. Production and processing can take up to 3–5 weeks before shipment. Shipping time is separate from production time.

3.4 Right to Refuse Orders
We reserve the right to refuse, cancel, or limit any order at our discretion, including suspected fraud or abuse.

4. Payment Terms

4.1 Accepted Payment Methods
We accept major credit and debit cards, Shop Pay, and other payment methods supported through the Shopify checkout system. By submitting payment, you authorize us (and our third-party processor, Shopify) to charge the full order amount, including taxes and shipping.

4.2 Taxes
Applicable sales tax will be added to orders shipped within states where we are required to collect tax.

4.3 Installment or Financing Services
If you use a third-party financing service (e.g., Shop Pay Installments), your agreement with that provider governs the payment terms. Haisel is not responsible for third-party financing decisions or fees.

5. Shipping & Delivery

5.1 Shipping Eligibility
We currently ship within the United States only. International shipping is not available at this time.

5.2 Processing Time
Most orders are made to order and require 3–5 weeks for production and processing before shipment. We do not guarantee delivery dates and are not liable for delays caused by suppliers, carriers, or factors outside our control.

5.3 Shipping Fees
Free U.S. shipping is offered on all orders unless otherwise stated.

5.4 Risk of Loss
Risk of loss transfers to the customer once the package has been marked delivered by the carrier. Haisel is not responsible for lost, stolen, or unclaimed packages. Customers must file a carrier claim for lost or stolen packages, but we will assist where possible.

6. Returns & Refunds

6.1 Eligibility
Returns for a refund are accepted within 10 days of delivery on unworn, undamaged, non-custom pieces in original condition and packaging. Custom, engraved, personalized, and made-to-order pieces are final sale and not eligible for refund.

6.2 Return Shipping Costs
The customer is responsible for the cost of return shipping. We recommend using a trackable and insured method. Haisel is not liable for lost return packages.

6.3 Refund Method
Approved refunds are issued to the original payment method only. Shipping fees and taxes are non-refundable.

6.4 Inspection Requirement
Returned items will be inspected upon receipt. We reserve the right to refuse any return showing wear, damage, alteration, or missing components. Unauthorized returns will not be refunded.

6.5 How to Request a Return
To initiate a return, email hello@haisel.studio within the 10-day window. Returns sent without approval may be rejected.

7. Trade-In Policy

7.1 Eligibility
Only Haisel solid gold pieces are eligible for trade-in. Items must be verified upon return and free of major damage or alterations.

7.2 Trade-In Credit Value
Eligible pieces may be traded in for 80–100% of the original purchase price in store credit only.

• 100% credit if traded within 12 months and in excellent condition
  

• 80% credit for visible wear, or trades made after 12 months
  
  

7.3 Credit Type
Store credit is issued as a digital gift card and is non-refundable, non-transferable, and cannot be exchanged for cash.

7.4 Trade-In Limits
Up to 3 trade-ins per customer per calendar year.

7.5 Shipping for Trade-Ins
Your first trade-in each year includes free insured return shipping. Additional trade-ins require customer-paid insured shipping or purchase of a Haisel return label (deducted from credit).

8. Warranty & Repairs

8.1 Lifetime Warranty for Manufacturing Defects
Haisel offers a lifetime warranty covering manufacturing defects only. This does not cover normal wear, scratches, patina, stone loss due to impact, resizing, theft, or loss.

8.2 Paid Repairs and Resizing
We offer repair and resizing services for a fee. Contact hello@haisel.studio for a quote. Customer is responsible for shipping unless covered under warranty.

8.3 Loss or Damage After Delivery
We are not responsible for damage, loss, or theft after delivery is confirmed by the carrier.

9. Store Credit & Gift Cards

9.1 Store credit and digital gift cards do not expire and may only be used toward Haisel purchases.
9.2 Store credit has no cash value and cannot be refunded or transferred.
9.3 Store credit issued for trade-ins is final and cannot be converted to a monetary refund.

10. Product Care & Wear Disclaimer

Solid gold does not tarnish, but it may develop a natural patina or surface marks over time. This is not a defect. Normal wear is expected and not covered under warranty. Jewelry should not be exposed to harsh chemicals, chlorine, or extreme force.

11. Intellectual Property

11.1
All content on the Site — including, but not limited to, product designs, photography, copywriting, branding, trademarks, logos, graphics, video, layout, and website code — is the property of Haisel LLC and is protected by U.S. and international copyright and trademark laws.

11.2
You may not copy, reproduce, sell, publish, distribute, modify, or create derivative works from any content without prior written consent from Haisel.

11.3
Unauthorized commercial use, including resale, scraping, or reproduction of product descriptions or imagery, is strictly prohibited.

12. User Conduct

You agree not to use the Site for any unlawful or prohibited purpose, including but not limited to:

• Attempting to interfere with or disable the Site
  

• Using automated tools (bots, scrapers) without permission
  

• Submitting false, fraudulent, or misleading orders
  

• Uploading viruses, malware, or disruptive code
  

• Impersonating another individual or business
  

• Attempting to reverse-engineer or copy proprietary processes, product descriptions, or pricing structures
  
  

We reserve the right to terminate access for any violation.

13. Website Content, Accuracy & Availability

13.1
We make reasonable efforts to ensure product information, pricing, availability, and descriptions are accurate. However, errors may occur and we reserve the right to correct them at any time, including after an order is placed.

13.2
We do not guarantee that the Site will always be available, uninterrupted, or error-free. We may suspend, modify, or discontinue the Site at any time without notice.

13.3
Colors and materials shown on screen may vary slightly due to monitor display and natural gemstone variation. Such variation does not constitute a defect.

14. Disclaimer of Warranties

To the fullest extent permitted by law, Haisel provides the Site and products “as is” and “as available,” without warranties of any kind, express or implied, except where expressly stated.

We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted access.

15. Limitation of Liability

To the fullest extent permitted by law, Haisel LLC, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profit, revenue, or goodwill, arising from:

• Use of the Site
  

• Inability to access the Site
  

• Purchase or use of products
  

• Shipping delays or carrier loss
  

• Unauthorized access to customer data
  
  

Maximum liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless Haisel LLC, its owners, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of:

• Your use of the Site or products
  

• Your violation of these Terms
  

• Your infringement of any third-party rights
  

This obligation survives termination of these Terms.

 

17. Governing Law

These Terms and any dispute relating to the Site, products, or policies shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law provisions.

 

18. Binding Arbitration Agreement

Except for claims eligible for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase from Haisel shall be resolved through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

You and Haisel waive the right to a trial by judge or jury.

 

19. Small Claims Court Exception

Either party may choose to bring an individual claim in small claims court (rather than arbitration) if the claim qualifies under applicable state law and remains an individual (non-class) action.

 

20. Class Action Waiver

To the fullest extent permitted by law, you and Haisel agree that all claims must be brought on an individual basis. You waive the right to participate in any class, collective, or representative action against Haisel LLC.

 

21. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect. Failure to enforce a right does not constitute waiver of that right.

 

22. Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time. Updated versions will be posted on this page with a revised Effective Date. Continued use of the Site constitutes acceptance of the updated Terms.
